Terms of Service

1. Agreement to Terms

By accessing and using Peakxel's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

Peakxel provides web development, design, and digital consulting services. Our services include but are not limited to:

• Custom website development (Next.js, React, etc.)
• Ecommerce platform development
• Web application development
• SEO optimization and digital strategy
• Figma-to-code conversion

3. Project Agreements

All projects are governed by individual project agreements that specify:

• Scope of work and deliverables
• Timeline and milestones
• Payment terms and pricing
• Intellectual property rights
• Revision and approval processes

These project-specific agreements take precedence over these general Terms of Service.

4. Payment Terms

Unless otherwise specified in a project agreement:

• A 50% deposit is required to begin work
• The remaining 50% is due upon project completion
• Payments are due within 7 days of invoice
• Late payments may result in immediate suspension of services and a fixed administrative late fee of $150 per delinquent month (non-interest based)

5. Intellectual Property

Upon full payment:

• You own the final deliverables and custom code created specifically for your project
• Peakxel retains ownership of proprietary tools, frameworks, and reusable components
• We reserve the right to showcase your project in our portfolio unless otherwise agreed

6. Warranties and Disclaimers

We warrant that:

• Services will be performed with professional skill and care
• Deliverables will substantially conform to agreed specifications
• We will fix bugs and errors discovered within 30 days of project completion at no charge

However, we do not guarantee:

• Specific search engine rankings or traffic results
• Compatibility with all future browser or platform updates
• Uninterrupted or error-free operation of third-party services

7. Limitation of Liability

Peakxel's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project in question. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Data loss or corruption (you are responsible for backups)

8. Termination

Either party may terminate a project agreement with 14 days' written notice. Upon termination:

• You will pay for all work completed up to the termination date
• We will deliver all completed work and source files
• Any deposits are non-refundable

9. Referral Program

Our referral program offers a 10% commission on referred projects. Terms:

• Commission is paid after the referred client's project is completed and paid in full
• Referrals must be new clients (not existing contacts)
• Commission is paid via bank transfer or PayPal within 30 days of project completion

10. Ethical and Fair Business Practices

Peakxel operates on principles of transparency, fairness, and ethical conduct. We explicitly reject the use of usury (interest) in our financial dealings. All fees are fixed and agreed upon prior to project commencement, ensuring a mutually beneficial and Halal-compliant business relationship.

11. Governing Law

These Terms of Service are governed by the laws of the jurisdiction in which Peakxel operates. Any disputes will be resolved through binding arbitration or in the courts of that jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the updated terms.
